General Terms and Conditions
1. Scope
These General Terms and Conditions (“Terms”) apply to all agreements between Santo Hospitality GmbH, Gewerbestrasse 5, 6330 Cham, Switzerland (hereinafter “HosCor”) and its customers regarding the use of the HosCor software platform.
2. Subject Matter of the Agreement
HosCor provides a web-based business management platform for businesses in the hospitality sector. The exact scope of functionality is set out in the current product description on hoscor.ch.
3. Prices and Payment
Use of the platform requires a subscription (CHF 36 per month or CHF 360 per year, as selected when the contract is concluded). Payments are processed through a payment provider engaged by us. All prices include statutory VAT where applicable.
4. Term and Termination
The subscription automatically renews for the selected billing period (month or year) unless cancelled before the end of the current period. Cancellation may be sent informally at any time by email to developer@hoscor.ch and takes effect at the end of the current billing period.
5. Customer Obligations
Access credentials must be kept confidential. The customer is liable for actions carried out using their access credentials, unless the misuse is attributable to HosCor.
6. Availability and Liability
HosCor strives for high platform availability but does not guarantee uninterrupted use. To the extent permitted by law, HosCor’s liability is limited to intent and gross negligence.
7. Data Protection
Information on the processing of personal data can be found in the Privacy Policy.
8. Changes to these Terms
HosCor reserves the right to amend these Terms with effect for the future. Customers will be informed of material changes by email.
9. Governing Law and Jurisdiction
Swiss law applies, excluding the UN Convention on Contracts for the International Sale of Goods. To the extent permitted by law, the place of jurisdiction is Zug.
